You may not upload or submit any data or information that contains viruses or any other computer code, corrupt files or programs designed to interrupt, destroy or limit the functionality or disrupt any software, hardware, telecommunications, networks, servers or other equipment. You may not engage in framing, mirroring, or otherwise simulating the appearance or function of the Site. You may not engage in any activities through or in connection with the Site that seek to attempt to harm minors or are unlawful, discriminatory, defamatory, libelous, pornographic, obscene, threatening, offensive, harassing, abusive, invasive of privacy or publicity rights, inclusive of hate speech, or would constitute or encourage a criminal offense, violate the rights of any third party, or give rise to liability or violate any local, state, federal or international law, either intentionally or unintentionally. You may not use the Site to transmit any false, misleading, fraudulent or otherwise objectionable communications. You may not engage in any activity that interferes with a user’s access to the Site or the proper operation of the Site. Any unauthorized use of the Site or its Features is prohibited.

Said license is without restrictions of any kind and without any payment due from Legal Playground to you or permission or notification, to you or any third party. The license includes, the right of Legal Playground to copy, improve, make, use, sell, reproduce, publish, remove, retain, add, process, modify, adapt, prepare derivative works from, combine with other works, translate, distribute, display, perform, sublicense, use and commercialize, in any way now known or in the future discovered, any information you provide, directly or indirectly to the Site. Any information you submit to the Site is at your own risk of loss. By providing information to us, you represent and warrant that you are entitled to submit the information and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights. 9. Mobile Services. If you access and use the Legal Playground Site through a mobile device, you agree that information about your use of the Site through your mobile device and carrier may be communicated to us, including but not limited to your mobile carrier, your mobile device, or your physical location. In addition, use of the Site through a mobile device may cause data to be displayed on and through your mobile device. By accessing the Site using a mobile device, you represent that to the extent you import any of your Legal Playground data to your mobile device that you have authority to share the transferred data with your mobile carrier or other access provider. In the event you change or deactivate your mobile account, you must promptly update your Legal Playground account information to ensure that your messages are not sent to the person that acquires your old number and failure to do so is your responsibility. You acknowledge that you are responsible for all charges and necessary permissions related to accessing Legal Playground through your mobile access provider.

 

 

10. Linking to the Site. You may provide links to the Site, provided that you do not remove or obscure, by framing or otherwise, any portion of the Site, including any advertisements, Terms and Conditions, copyright notice, and other notices on the Site; you immediately deactivate and discontinue providing links to the Site if requested by Legal Playground; and Legal Playground may deactivate any links at its discretion.

15. Agreement to Pay. You agree to pay for all services, mobile applications, or products you purchase from Legal Playground, and for any additional amounts (including any taxes and late fees, as applicable) as may be accrued by or in connection with your purchase(s). You are responsible for the timely payment of all fees. All fees will be billed to the credit card you designate during the purchasing process. If you subsequently want to designate a different credit card or if there is a change in your credit card status, you must advise Legal Playground of the change.

NEITHER LEGAL PLAYGROUND NOR ANY OF ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, BUSINESS PARTNERS, LICENSORS OR LICENSEES SHALL BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF THE SITE, THE FEATURES, THE POSTINGS, THE INTERACTIVE AREAS, ANY FACTS OR OPINIONS APPEARING ON OR THROUGH AN INTERACTIVE AREA, OR ANY THIRD PARTY COMMUNICATIONS. 18. Indemnification. You agree to indemnify, defend and hold Legal Playground, its affiliates and subsidiaries, officers, directors, employees, agents, business partners, licensors, and licensees harmless from and against all claims, suits, actions, demands, proceedings, losses, expenses, liabilities, damages and costs, including, but not limited to, reasonable attorneys' fees, resulting from (1) your failure to comply with the terms and conditions of this Agreement, including, without limitation, any actions caused by you that violates third party rights or applicable laws, (2) any content you submit to the Site, and (3) your use of the Site. You shall use your best efforts to cooperate with Legal Playground in the defense of any claim.

 

 

19. Misuse of the Services. Legal Playground may restrict, suspend or terminate the account of any user who abuses or misuses the Site. Misuse of the Sites includes, but is not limited to, abusing the messaging services; creating multiple or false profiles; using the Site commercially without Legal Playground’s authorization, infringing any Copyright or intellectual property or rights, or any other behavior that Legal Playground, in its sole discretion, deems contrary to its purpose.

 

 

20. Unlawful Activity. Legal Playground reserves the right to investigate complaints or reported violations of the Terms and Conditions and to take any action we deem appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.

 

 

21. Remedies for Violations. Legal Playground reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions, including but not limited to the right to prosecute violators to the full extent of the law, and discontinue the Site or terminate your access to it at any time, without notice, for any reason and without any obligation to you whatsoever.

 

 

22. Governing Law and Jurisdiction. This Agreement shall be governed and construed in accordance with the laws of the United States and the State of Florida, and the parties consent to the sole and exclusive jurisdiction of the state courts and U.S. federal courts having jurisdiction in Broward County, Florida for any dispute arising out of this Agreement.

 

 

23. Privacy. Your use of this Site is subject to Legal Playground's Privacy Policy. You should carefully read the Privacy Policy before deciding to become a user as it governs our treatment of any information, including personally identifiable information you submit to us and the Site. Please note that certain information, text, statements, data and Features, including but not limited to photographs, which you may submit to Legal Playground, the Site, your profile, blogs, or forums, might, or are likely to, reveal your gender, ethnic origin, nationality, age, religion and/or sexual orientation, and/or other personal information about you. You acknowledge that your submission of any information, text, statements, data, and Features to us and the Site is voluntary on your part.

 

 

24. Severability of Provisions. If any provision of this Agreement is found by a court of competent jurisdiction to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; and if a court finds the modified provision invalid, illegal, void or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement will not be affected in any way.

 

 

25. Entire Agreement. This Agreement constitutes the entire, complete and exclusive Agreement between you and Legal Playground regarding the Services offered and provided by Legal Playground and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of this Agreement. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Legal Playground services, including its Marketing Services. You should carefully read the Marketing Services Terms and Conditions before agreeing to purchase the services. If you do not agree with any of the Marketing Services Terms and Conditions, you are not permitted to order Legal Playground’s Marketing Services.

 

 

26. No Informal Waivers, Agreements or Representations. Legal Playground’s failure to act with respect to a breach of this Agreement by you or others shall not be construed as a waiver or limitation of Legal Playground’s right to subsequently enforce and compel strict compliance with every provision of this Agreement. Except as expressly and specifically contemplated by the Agreement, no representations, statements, consents, waivers or other acts or omissions by any Legal Playground affiliate shall be deemed legally binding on Legal Playground, unless documented in writing by a duly appointed officer of Legal Playground.

 

 

27. Modifications to Terms and Conditions. Legal Playground reserves the right to modify, supplement or replace these Terms and Conditions at any time. Updated versions of the Terms and Conditions will appear on this Site and are effective immediately. You are responsible for regularly reviewing the Terms and Conditions. Continued use of this Site after any such changes constitutes your consent to such changes.
